Restaurant Industry Profits Continue to be Challenged by Employee Theft and Drugs in Workplace

REDUCE DRUGS – THEFT IN THE WORKPLACE

Having spent several years mentoring to a young college student in developing a health food chain, I realized very quickly that theft was a daily battle in our Business. My experience actually started some 45 years ago where one summer in high school I had the opportunity to work in a very exclusive Yacht Club where the dining room was the second biggest draw other than sailing. Interestingly enough I learned every aspect of the restaurant business from working as a dishwasher, waiter, bartender, manager and eventually as I mentioned co-owning a Franchise Food Chain. Theft of course is commonplace but controlling what may even be acceptable has its own consequences. Is 3-5% acceptable or even worse the fact that the management does nothing about it other than terminating the employee and rehiring and recycling what could become a much bigger problem?

In the same regard almost every Restaurant owner I have consulted with over the years have mentioned where drugs or alcohol at some point were a factor in their workplace environment whether in the kitchen, the parking lot or around the employees in general. I remember in one of those early jobs I mentioned where the manager spoke to the staff about the seriousness of how dangerous kitchens can be if someone is using drugs or alcohol. Everyone either laughed under their breath or the message was just ineffective. About a week after that speech, a dishwasher who was seemingly okay, not under the influence was working with scalding hot water to clean the dishes. What happened due to his lack of focus and attention was allowing the scalding water to go down into his long protective rubber gloves and he could not react fast enough to get his gloves off and under cold water. This employee was taken to the emergency room and had 2nd and 3rd degree burns on both arms and was scarred for life. He was drug tested at the hospital because the doctor felt that he might be impaired, only to discover he was on barbiturates and drinking heavily before coming into work. Drugs are in our society and are here to stay and as previously mentioned are a common occurrence at Restaurants on a daily basis.

Restaurant owners that we have worked with over the years are finally taking the position that any loss of revenue is unacceptable. So whether it’s cash or credit card theft from the customers, food, alcohol, beverages, silverware, paper goods and other items going out the back door or drugs trading hands on the restaurant property it all greatly impacts the Restaurants bottom line and the atmosphere of the workplace.

At CSI Secure Solutions we are now working to assist owners in combatting theft and drugs in the workplace either thru risk & security assessment surveys, covert technology implementation, undercover operations, Background Screening, Drug Testing and program implementation that stops these issues at the front/back door or before the employee even gets to HR!

WHY COMPANIES USE PRIVATE INVESTIGATORS FOR EMPLOYEE INSURANCE FRAUD CLAIMS

Insurance Fraud Claims

An employee may sustain an injury on a job. Accidents resulting from work are acceptable claims. Workers who suffered from injuries like sprains, fractures or lost a finger to a cutting machine are entitled to compensations. Usually, these requests are accepted if the mishap occurred in the presence of other employees or the supervisors. Often, workers fake personal injury or accidents to make false claims. A private investigator can probe suspicious injuries to determine whether the concerned employees are making fraudulent claims.

The findings of the investigation can prove any deceit by the employee. The investigator’s report and evidence are useful in accepting or rejecting the claim. The insurer can also assign a physician to examine the injury. Inflating a legitimate claim is the most common type of insurance fraud. Conversely, damaging a property intentionally such as crashing a car and similar cases are minimal. Employees are not the only perpetrators of insurance fraud; an insuring company can also be the offender. Besides deceitful request for benefits, insurers can also swindle injured employees. They may allege lost paperwork or falsely deny payouts.

Victims of insurance fraud can suffer from falsified claims, denied settlement, increased premiums and more. Any attempt to obtain compensation for inflated or falsified claims can raise the premium for others. However, private investigators can resolve such deceptions. These professionals are reliable and efficient in acquiring information that can implicate the wrongdoers. Hire a private investigator if you are a victim of insurance fraud. The expert can deliver accurate results that will enable you to collect the correct entitlement.

Investigation of insurance fraud is crucial to reduce high premiums caused by various deceptions. Private investigators who are experienced in interview and surveillance skills can solve the fraud through the following techniques.

  1. Background research: A check on an individual can reveal previous involvement in the scam. The criminal record of a claimant could indicate the tendency to deceive others. A search on the report of past accidents can disclose if they are on purpose. An organized group performs staged mishaps such as car crashes. The activities of such team can extend over a period. The financial history of an employee can indicate the propensity to inflate or falsify a claim. Besides, financial distress can lead to insurance fraud.
  2. Surveillance: This technique is important in determining any inconsistency in the lifestyle and activities of an employee with suspicious injuries. Private investigators use surveillance skills to acquire compelling evidence against fraudulent claimants. The investigative method requires caution to avoid charges of harassment. Professionals can monitor their subject secretly from a safe distance.
  3. Interviews: Professional and highly skilled Private investigators possess exceptional skills for interviewing the claimant and witnesses of a suspected insurance fraud. This technique can uncover the truth about a case. The claimant may even be a victim of an accounting fraud by a contractor or an insurance agent. A doctor may overbill an employee, or the person might have purchased a fake policy. The investigator can identify the real fraudster through the inconsistencies in the interviewee’s statements.
  4. Social Media: Uploads on social media can incriminate a person that claimed an injury. The pictures or recent videos that are not consistent with their claims are valuable in proving their offenses.

Private investigators can solve cases of withheld benefits and exaggerated or falsified claims. They can discreetly and efficiently acquire evidence to show that insurance fraud occurred.

FORENSIC INVESTIGATORS RESOLVING CYBER CRIMES

Crimes committed using the computer networks are increasing at an alarming rate. Due to the speed and anonymity of the Internet, these criminal activities can cause harm to individuals and businesses. Cyber criminals use computers as tools to commit identity theft, hacking, fraud, phishing and other crimes. They can access business trade secrets to exploit their victims. Through forensic investigations, experts can recover proofs of these Internet crimes and verify the perpetrator’s defense.

Forensic investigators can provide a special skillset to resolve cases of intrusion, data breaches, and other cybercrimes. By examining computer systems, they can retrieve encrypted or deleted data that will enable them to pin offenders. Companies require the services of these professionals to resolve cases of cybercrime and enhance the security of their Internet network. Most investigators combine forensic skills with traditional techniques to obtain information during investigations.

Process of Forensic Investigation

Forensic experts can recover data from technical tools without damaging its integrity. The valuable information gathered during cyber crime investigations can serve as evidence. The systemic approach to this investigative process can involve these steps:

Acquisition of Data: In the event of any crime, computers and other digital devices will be scrutinized for implicating information. Ordinarily, experts use hard drives for forensic examinations. Criminals do delete files that will implicate them to outsmart the law. However, this action only hides the files from them. Such files still exist on the system’s hard drive and can be recovered. The random access memory, RAM, can lose data stored on it but investigators can retrieve this information from the hard disk. However, forensic investigators should recover information as soon as possible from computers to avoid losing them permanently. Over time, the data contained on the hard drive may be overwritten as it receives newer files from the RAM. Due to advanced technology, experts can duplicate data on computer memory using an innovative tool without turning on the system. Some criminals can encrypt incriminating data. However, most of these cautious offenders do fail to encrypt all their files. This oversight allows investigators to examine the unencrypted data for evidence. Besides, forensic experts can analyze protected files if the criminals have reused passwords.

Assessment: Investigators can use different techniques to examine the acquired information. Data collection is performed before shutting down the computers (live-analysis) or after they have been turned off (dead analysis). The “live” technique is useful in recovering fingerprints on computers. Forensic experts can also carry out live analysis to obtain evidence instantly using unique analytical tools.

Analysis: Detectives and lawyers can use data recovered from computers to prove cases. A forensic investigator can identify security lapses in any network that suffered a breach of data or intrusions. This discovery will be useful in the identification of the criminals using the gathered information. Interpretation of digital evidence is crucial to resolving cyber crimes.

Documentation: A written report from investigators is useful as evidence. An attorney can use such testimony during court proceedings. Besides providing proof for prosecuting a crime, a forensic investigator can testify in the court.

Besides investigating cybercrimes, computer forensic investigators can also test network security systems for companies. The professionals can enhance the performance level of computer system.

CHILD CUSTODY CASES ARE FIGHTING PARENTS + CHILDREN AS HOSTAGES

CHILD CUSTODY CASES =CHILDREN NEVER WIN
CHILD CUSTODY CASES =CHILDREN NEVER WIN

As often as I write about Child Custody cases it never get’s easier, either the pain the children go through or the two parties wrestling for control, and there lies the usual focal point. Not what is in the best interest of the child but which parent wants to seize more control as if it was some type of “game of wits”! The parents, the children and the storyline is always the same. The social dynamics whether wealthy, middle class or poor does not change the outcome unless one side has more money and can afford an attorney and the other side cannot. I have seen in cases like this where the Magistrates or Judges will bend over rightfully so to balance the scales regarding representations of each party but still not knowing the “full history” of the case!

But the real point here for me once again is when one or both parents use the children as described above under false pretenses which is disgraceful and despicable at best. I have unfortunately witnessed this in my own family where the child’s needs emotional stability which is seemingly secondary only to have one or even both of the parents talking like it is a game. The courts are often times over run with these child custody cases and not fully apprised of the full background of both parties until the day of the hearing when a quick decision is made with so much at stake. In other articles I have written I address the supporting service structures such as the Department of Children Service and how they are often times brought into cases under false pretenses by one of the parents trying to make the other parent look negligent and manipulate the custody outcome of the child. This is a very broken system but not just because the resources are limited but also the way the parents fabricate “story’s” about the other parent in order to wrestle control of the child for no reason at all other then to “WIN”!

STAY TUNED!!!!

HOW PRIVATE INVESTIGATOR RESOLVE THEFT OF CLIENT LISTS

Theft of trade secrets such as customer lists is a criminal offense. A client list becomes a trade secret if a former employee copies or steals it from an ex-employer. However, a list compiled from other sources outside a former employee’s venture is not a trade secret. Also, it is not a criminal offense if an ex-employee remembers the phone numbers of customers that the person has contacted previously.

Most companies depend on client lists to develop relationships with their customers and boost their businesses. A departed employee may leave an enterprise with such information. It might be easy for any employee to obtain the customer list if the employer did not protect it. However, such confidential information remains the property of the company. An ex-worker can use it to solicit for the enterprise’s customers.

Consider the case of an employee who used stolen client list to contact the ex-employer’s customers while working for a competitor. The individual also recruited some employees in the former company for the new employer. Poaching of employees can be illegal in some circumstances. Such complicated incidents can affect the productivity of enterprises. In such situations, hiring a private investigator is an ideal solution.

 *Detection of Data Fraud

Information theft such as client list by former employees can cause a company to lose profits. The organization may even go out of business as a result of such significant loss. Employing a private investigator once an attack on the customer list is suspected can save a company from such situations. The professional investigator can find evidence of any illegal act against the company by a former employee.

The investigator can get facts about the services of the suspected ex-employees when they were working for the enterprise. Monitoring the activities of these individuals will help in detecting the offender. The suspect’s work computer may even contain evidence of the unlawful act. With the proof obtained by the investigator, an ex-employer can file a lawsuit against a former employee. A legal action will not only halt the use of the stolen information but may also allow the ex-employer to claim damages.

*Staff Poaching

Employees are the lifeblood of any business organization. However, a better offer from another company can cause them to leave their present employers. A company may suffer a significant loss if a former employee working for a competitor poaches the ex-employer’s workers. Sometimes, a key employee may leave an enterprise to set up a rival business and then recruit the ex-employer’s staff. Though an employee is free to leave a company, there are legal restrictions for team defection.

A private investigator can detect whether the poaching of employees is coordinated secretly by some present workers of the company. Such action is a breach of contract by these employees. The expert can also find out if any of these former employees have stolen any confidential information.

The evidence obtained by the investigator can aid a business owner to take legal action against current employees that persuaded others to defect to a competitor. Also, the court can grant an injunction restraining any employee that set up a rival business to desist from using any ex-employer’s confidential information.

Employers should restrict access to sensitive data. Implementing a digital forensic policy in companies can deter data theft and aid investigation process.

Corporate Investigations Be Handled by Inside or Outside Professional Investigators ?

Employee Theft

Various incidents can occur at a place of work. These occurrences can require the attention of the management or even a private investigator if the issue is complicated. Ignoring such happenings can tarnish a company’s reputation and even affect the business negatively if the issue becomes public. Consequently, it is better to investigate any dispute in an enterprise properly.

Employers can settle conflicts on misconduct, interpersonal matter or performance of workers without involving a private investigator. However, legal counsel may be essential in some instances. Issues associated with allegations of violence, harassment, discrimination, drugs, theft, and identity fraud or other serious problems should be investigated.

Many employers may prefer to resolve conflicts internally. Such managers may feel that hiring a private investigator is intrusive. However, complicated issues can get out of proportion if not properly investigated. Employers who hinder investigative processes will be held liable for serious incidents that occur in their organizations.

Private investigators are individuals trained to scrutinize complex issues in companies especially those with business and/or corporate backgrounds.

They are impartial and neutral to such occurrences. These professionals can obtain information that can be useful in resolving such matters. They know how to get evidence relating to any alleged wrongdoing. These experts can interview the witnesses and parties involved in the case and record their statements. Also, their services are useful if a legal action results from an incident.

Here are situations that will necessitate the services of a private investigator.

• Inexperienced Company Investigator: Workplace investigations require adequate training. An outside professional is needed if the company investigator is not experienced to investigate an incident.
• Biased Judgment: The company investigator may not be trusted if he has any relationship with the witnesses or individuals involved in an incident.
• Questionable Credibility: The impartiality of an investigator may be doubted if a senior employee took part in the case under investigation. The status of the senior worker may influence the credibility of the investigator.
• Serious Allegations: It is better to hire a private investigator to handle serious issues such as theft, violence, sexual harassment, discrimination, and others. An outsider will be neutral to the incident under investigation since he is not an employee of the company.
• Legal Action: A report and film evidence by a private investigator may be required if litigation follows an incident.
• Employees’ Perception: In many cases workers feel more comfortable to discuss an alleged wrongdoing with an outsider whom they

perceive to be neutral to the case than a senior employee or internal investigator.
• Media Attention: The services of a private investigator can help maintain the reputation of the company if an incident may attract public attention. Hiring an outsider to scrutinize an alleged misconduct indicates the organization’s concern in the maintenance of a secure working environment.

Hiring a private investigator can in fact boost the morale of the employees. It gives them the impression that their employer is concerned about their welfare. Relying on an internal investigator may dampen their spirits, as the credibility of the investigation is questionable. Besides, licensed private investigators depending on their background can bring the necessary experience required for Corporate Investigations They can carry out most workplace investigation efficiently and beyond reproach. Employers should strive to maintain a safe working environment by resolving workplace incidents appropriately by using the expertise of a highly skilled private investigator.

BENEFITS OF UNDERCOVER OPERATION IN YOUR COMPANY

Over the years companies have fallen victims of many unethical practices in the workplace. It is sad to say that most of the issues that affect the performances of most companies come from internal forces. It would have been better to think of an outsider posing threats to the company than the people who claim to have their loyalties aligned with the company. With most management,it has never come across their minds that they could be dealing with an enemy that is in the inner circle; employees. A threat may pose against the company and the last place the management think of looking is within their own organization.

CSI Secure Solutions is a company that has mastered its skills when it comes to issues concerning undercover operations and private investigations. With their vast experience in the areas named above, they are capable of handling any situation effectively, efficiently and reliably. CSI Secure Solutions has devised some ways to ensure that all the internal threats are taken care of way before they actualize.

An undercover operation is a security measure that is extremely vital for any company that wishes to have its ears and eyes on the ground within the company. This type of security measure involves having a person within the company who will be secretly sourcing information from the workers. The information is then presented to the management so that they can take the necessary steps to counter the problem.

An undercover operator in place means that all the internal forces working against the company will be quickly discovered. Therefore, a company is more aware of the happenings amongst the employees at all times. More often than not, many top management officials are never in close contact with the workers, and even if they are, most workers hide their true natures. This way, most officials have the impression that their staff is excellent. This is where the undercover operator comes in as they will be able to prove their excellence or lack thereof.

Some of the things that can hurt a company’s performance includes, selling of vital information to a rival company, incompetent employees who skip work on some days and get others to clock in and out for them, selling out the clients list to competitors and even using the company’s internet or telephone for personal gain just to mention a few.

Having an undercover operator to track down or monitor such activities and report back to the top management could save tens of thousands of dollars per year or more in payroll costs. These threats are serious and can lead a company to collapse because the workers can share with competitors or future employers all the things that make them stand out. When your competitor gets vital information about the company, they will use it to bring the company to its knees.

Take up the responsibility to ensure that your company is always secure against external and internal forces by putting in place an experienced and professional undercover operator who will have your interests at heart with no malicious intent.

Abduction and Recovery in Child Custody Cases

Welfare and Safety of an Abducted Child

It has become an International crisis, that some people men or women have cultivated the habit of abducting other people’s children as their own. It is a daily battle to help the abducted child get back to their home and reunited with their family. However, it is also emotionally devastating when you get to know that another parent who has no custodial rights is keeping your child from you. How to get back your child is the next thing that comes to your mind, and the next action to take is to contact an experienced private investigator. Unfortunately when you contact law enforcement agencies they cannot offer you the services that you will get from a private investigator concerning child abduction, so they don’t see it as a crime as opposed to a civil action.

In order for these child abduction cases to be resolved there are many times that there is the need for Private Investigators to take drastic steps. Private Investigators are asked to assist the family lawyer of the abducted child in carrying out a plan of action on how the child will be legally returned to the parents. Understandably, it is a tough period for both the missing child and the parent when they are not together knowing that they are looking for each other. The private Investigators provide compassionate and attentive investigative steps to help minimize the anxiety of meeting your child most especially if your child has been taken across state lines or out of the country. The moment you notice that your child has been taken across state lines these experienced Private Investigators will relentlessly pursue your child’s return.

Interstate Abduction

Stiff and rigid laws are in places that prevent abduction by parents and to avoid the delaying and return of the child. The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) has succeeded in establishing a uniform criteria for determining jurisdiction and enforce pick up orders so the child can be returned to their home state. This Law also requires the state to assist in the safe return in where the abducting parent has taken the child.

Another law is the Parental Kidnapping Prevention Act (PKPA), which assists in curbing illegal child abduction and also provides the federal enforcement agency’s to ensure state action as well. Also this Law respects the custody and relocation decisions of other countries, although the PKPA requires the court to enforce laws rather than to modify custody and visitation orders of other nations.

International Child Abduction

The cultural and international marriages that lead a relationship to the birth of a child are on the rise. Occasionally when marriages end up in divorce or relationship breakup, it ignites that international relocation and abduction by a parent. Different international child abductions are treated and governed by The Hague Abduction Convention that was made to protect children internationally from the harmful effects, forceful removal and kidnapping just to set up a legal procedure to ensure their prompt return to their real homes and empower the protection and parental access to the child.

The essence of this article is to express the emotional pain and distress when a child goes missing, what it takes for a parent to locate an abducted child and how the Human rights activists can help in making a child gets back home and reunited with his/her, parents.

CSI-Secure Solutions is ready to assist you any point in time you encounter issues with child abduction cases and that is why we still have the best Team of Professional’s when it comes to providing private investigator services for Child Custody issues.
